Tom Sherwood defeated an insured’s breach of policy action, successfully arguing on summary judgment that the subject title policy unambiguously insured only one lot, not two lots as the insured claimed. The United States District Court for the Southern District of New York dismissed the insured’s action, finding that the policy’s one-time inclusion of a street address used to refer to two different parcels of property did not render the policy ambiguous as to the identity of the property insured.
