Amy Abbandondelo Succeeds on an Appeal in the Second Department

Amy Abbandondelo successfully argued before the Appellate Division, Second Department, persuading the appellate court to modify the lower court’s decision denying in part our client’s motion to amend its complaint to join an additional defendant and to assert a claim for fraudulent misrepresentation. The Appellate Division held that the proposed fraudulent misrepresentation claim was sufficient on its face due to the allegations that our client, a title insurer, reasonably relied upon the defendants’ sworn misrepresentations as to the payoff status of an open mortgage of record. Amy Abbandondelo and Jim Truitt drafted the briefs.
