Jim Truitt and Amy Abbandondelo Obtain Dismissal of a Breach of Title Policy Action

Jim Truitt and Amy Abbandondelo obtained summary judgment on behalf of a title insurer dismissing an insured’s action alleging breach of the subject title policy. The insured sought coverage for its neighbor’s alleged adverse possession of a 5’ x 15’ portion of the second-floor of the insured’s building, resulting from the neighbor’s predecessor’s apparent expansion of a living room into the insured’s building. Jim Truitt and Amy Abbandondelo established that the insured’s claim fell within the “persons in possession” exception of the policy and, therefore, was outside the coverage afforded under the policy.
