Jim Truitt Successfully Argues before the Second Circuit Court of Appeals

Jim Truitt successfully defended against an adversary’s appeal to the United States Court of Appeals for the Second Circuit from a decision of the United States District Court for the Southern District of New York that granted our client summary judgment dismissing the case against it. In affirming the District Court’s decision, the Court of Appeals held that although our client’s mortgage was ambiguous on its face as to the property encumbered, the extrinsic evidence, including numerous loan documents that the borrower executed, established that the mortgage encumbered the plaintiff/appellant’s property.
