Successfully Argued Appeal before Appellate Division, Second Department

(May 2019) Amy Abbandondelo successfully argued before the Appellate Division, Second Department on behalf of a junior lienholder, obtaining an order affirming the lower court’s order denying the senior lienholder default interest and late charges due to the senior lienholder’s failure to timely prosecute its mortgage foreclosure action.

(April 2019) Tom Sherwood and Robyn Fearon obtained judgment in favor of money judgment creditor declaring that debtor’s transfer of assets into family trust violated New York Debtor and Creditor Law, and obtained further money judgment in favor of creditor against trustee of family trust.

Negotiated Favorable Settlement in Quiet Title Action

(March 2019) Amy Abbandondelo and Tom Sherwood obtained a favorable settlement for a private mortgage lender in an action seeking to set aside an allegedly fraudulent deed into the lender’s borrower and to invalidate the lender’s mortgage, resulting in the lender recovering 100% of the amount due and owing under the mortgage.
